MJC夜市照旧 小贩团结战胜朋党主义操控

巴市会接管石角夜市后收费营业时间地点照旧的决定,是该夜市小贩们团结对抗战胜朋党主义操控的胜利成果。

民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁如是指出。
张健仁列出以下有关石角MJC夜市管理权纠纷一系列事件的时间表:
1. 2008年该夜市开始,一开始就是由Triple-S这件公司和FAMA各别管理一半,向小贩们徵收的收费则是每天5令吉,一个星期营业2天。
2. 2015年3月,巴达旺市议会(巴市会)发函欲终止Triple-S和FAMA的管理权,并交由另一家私人公司接管。 该私人公司则立刻向小贩们徵收一天19令吉的执照费,并强制全部小贩每个星期必须营业5天。
3. 小贩们群起抗议,并由Triple-S公司的负责人带头反对这个新条例。 结果,巴市会收回管理权的终止信,并继续由Triple-S继续管理。 FAMA那一带的小贩们则因为FAMA接受有关终止信,巴市会则任由他们自己管理。
4. 2016年6月,砂州州选过后,巴市会再次出信终止Triple-S的管理权。 今次,巴市会没立刻宣布委任那间私人公司处理。 不过,该夜市则同时出现另一第三者开始在该夜市进行清理垃圾和重画小贩摊位的黄格。
5. 2016年8月16日,该夜市小贩与张健仁和Triple-S负责人一起上报,公开反对巴市会终止Triple-S的管理权而同时又把夜市的管理权给另一家新公司管理。 他们担心去年的新收费和新条件会再重演。
6. 2016年8月20日,Triple-S收集小贩们的签名,获得超过95%他所管理的小贩们的签名,支持他继续管理该夜市,并反对巴市会调高他们营业的收费率。 这签名证据也由张健仁和Triple-S负责人在报章上公布。 同时,该Triple-S负责人也公开表示,如果巴市会答应徵收原有或更低的收费及维持同样的营业时间条件,为了小贩们的利益,他将接受巴市会的终止信,不继续对抗。
7. 2016年8月26日,巴市会开会决定收费率照旧,而夜市也不需迁去新地点。
张健仁指出,从这一系列事件的发生和时间表,明显可见的是,在今年6月当巴市会终止Triple-S的管理权的当儿,巴市会根本就没有意愿要维持原有的收费率。 不然的话,为何要等到终止Triple-S管理权超过两个月后,才开会决定是否保持原有的收费率。
“一个市议会,在终止夜市管理权之前,不可能没有事先决定是否维持或调整夜市小贩们的执照费。 巴市会迟迟不公布新的执照收费率,可见其原来的意愿是要增加他们的执照收费,因此不敢事先公布,怕惹公愤。
“另外,如果巴市会没有给予默许或口头同意,那新的第三者又如何会突然在巴市会终止Triple-S管理权后,出现在该夜市清理垃圾和画黄格? 巴市会主席罗克强和该第三者,是否事先已有一些协议,一切都不言而喻。”
张氏表示欣慰,因为小贩们的团结和勇敢抗议,最终巴市会在两个月后才决定维持原来的执照费。
张氏希望巴市会昨日的公布非只是权宜之计,等事情告一段落,再调整该夜市小贩的执照费。
他说,毕竟Triple-S这家公司可以在过去8年,都以同样的5令吉一天的收费维持和清理该夜市。 巴市会没有理由不能以同样的收费率,继续维持和清理该夜市多几年。
因此,张健仁希望巴市会言而有信,在今后的几年不调整这些小贩们的执照费以及不另外委新的私人公司接管该夜市。
“小贩们虽然不是什么有权有势的人,但是他们同样是马来西亚公民,是砂拉越人,他们有权捍卫他们谋生的权利。 市议会的责任是提供他们便利谋生,非企图从他们身上赚取市议会额外的收入和利润。”

取消徵收河道维修费 非延迟



砂州政府应取消徵收“河道维修费”的决策,而非只是单单的延迟该收费计划至2017年6月1日。
民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁指出,古晋海港局于今年6月公布将于今年6月1日开始,徵收一项“河道维修费”的新收费,而收费率是:
1. 每20尺货柜RM36.25,40尺货柜则收费RM72.50;
2. 普通货物则收费每一顿RM1.00。
张氏表示,这新收费是相等于古晋海港局过去的收费增加了20%。 而保守估计,这所谓的“河道维修费”,一年将为古晋海港局多收1100万令吉,换言之,砂州人民一年将多还1100万令吉给古晋海港局。
“当古晋海港局之前公布这新收费时,只有行动党大力的反对,并于6月29日在各大报章上大力抨击砂州政府的这项决策。 遗憾的是,人联党对此政策,噤若寒蝉,不敢出声。”
张氏表示欣慰看到他的抗议得到一些成果,至少,目前古晋海港局押后一年才落实这项收费。 换句话说,行动党的抗议,为了砂州人民节省了1100万令吉。 这又是一个强有力的佐证,在野党的重要和效应。
“但是,对于海港局的押后一年收费的宣布,我感到的欣慰,只是‘半高兴’而已。 因为政府本来就不应该有这种莫名其妙的‘河道维修费’的收费。 这根本就是胡乱找个藉口向人民开刀。”
张氏说,古晋海港局不应有这种“河道维修费”的收费,其原因有3,即:
1. 河道是公共基建设施,就如道路和沟渠,政府有责任维修。 这些船务公司已有还海港局费用和政府税务。 因此政府不应该另外再加收多20%的收费,美其名为河道维修费。
2. 古晋海港局的河道加深工程安装政府的预算,最早将于2019年竣工。 新的河道工程还未完成,何来维修工作?
3. 砂州的货物运输费远较西马的货物运输费高。 这较贵的运输费,不只是对砂州人民是一种经济负担,而且,对砂州的企业,也是额外的成本,有损砂州中小型企业的竞争力。 砂州政府应尽量减低运输费的开支,而非反其道的加重运输费的开支。
“因此,我呼吁砂州政府取消这‘河道维修费’的额外收费,而非单只押后收费一年时限。 同时,古晋海港局也应退还之前船务公司所缴付的‘河道维修费’。”

Call upon the State Government cancel Channel Maintenance Recovery Charges

I welcome the Kuching Port Authority’s announcement to defer the collection of “Channel Maintenance Recovery Charges” after I brought up the objection in the media on 29-6-2016 against the collection of the said Charges.
As always, it was only the DAP objecting to the said Charges on behalf of the people. SUPP just kept quiet about it, afraid to object to any of the State Government’s policy until green light is given by Adenan.
This is again another proof of an effective opposition which saves Sarawakians an estimated sum of RM11 million for the one-year period starting from 1-6-2016.
The initial announcement for the collection of the said Charges was made in June, 2016 to take effect on 1-6-2016 and the rates charged were
RM36.25 per TEU (RM35.25 per 20’ container & RM72.50 per 40’ container)
RM1.00 per ton or loose cargo
This additional charge constitute approximately an extra 20% increment in port charges on cargo shipment.
While it is good that shippers are now spared the said Charges, there is still no justification for the Kuching Port Authority to start collecting the Charge starting 1-6-2017.
Firstly, channel is public infrastructure. The Government has a duty to maintain it, just like roads and drains. The shippers has already paid port charges and taxes to the Government. As such, there should not be another extra 20% charges for the maintenance of the channel.
Secondly, the channel deepening project is only slated to be completed by 2019. Therefore, KPA should not start its collection of the said Charges before the project was completed.
Thirdly, transportation costs on goods to and from Sarawak is a lot higher than the transportation costs on goods to and from West Malaysia. Such high transportation costs are not hurting the general Sarawak consumers but also hurting our Small medium industry. The State Government should not add further costs on the already high transportation costs of Sarawak.
I therefore call upon the State Government to cancel this Channel Maintenance Recovery Charges in toto, not just deferring it to 1-6-2017. The KPA should also refund those “Channel Maintenance Recovery Charges” collected from the forwarding and shipping companies.

Urged Adenan Stop Land for the Cronies policy

Adenan should not carry on with the “Land for the Cronies” policy which is the trademark of his predecessor.

There were in total 3 rounds of acquisition of the land in the Kampong Gita area:
1. 16-5-2014 for construction of access road;
2. 3-12-2014 for urban development; and
3. 18-6-2016 for urban development.
The first round of land acquisition (16-5-2014) was for the construction of access road. No one objected to the acquisition, because it is for a genuine “public purpose”.
The second round of land acquisition (3-12-2014) involves the acquisition of a total 132.8 acres of private land. Although the declaration for the acquisition of the 132.8 acres of land was made as early as in December, 2014, the Government only issue notice of the said acquisition as late as in mid-July, 2016, almost 2 years later. This is HIGHLY UNUSUAL.
Is the Government worried that had such notices been issued in 2015, it will affect the performance of the Sarawak BN in the Sarawak State elections? As a result of this consideration, the notices of the acquisition were only sent out after the State Elections.
The third round of land acquisition (18-6-2016) involves the acquisition of 15.440 acres of private land. It is as if the 132.8 acres of land is not enough for the “BN crony”, that it needs another 15.44 acres, making it a total of 148.24 acres of private land to be acquired.
Notices for the acquisition for both the second and third rounds of the acquisition were issued at the same time, i.e. mid-July, 2016.
During the enquiry, when the Land and Survey officers were asked what is the “urban Development” that requires 148.24 acres of private land to be acquired, they have no answer to it. When we asked for the so-called “urban development” plan, they told us “NO PLAN YET”. They officers mentioned that there will be some water-front projects, shophouses and residential property.
It is not the government’s job to develop shophouses and commercial centres, especially to take private land for “crony” to develop shouhouses. This is called “land-grabbing”.
Sarawak, in general, had suffered under the “land-grabbing” policy of the previous administration for more than 20 years.
When Adenan became the new Chief Minister on 1st March, 2014, most Sarawakians had high hopes of him when he mentioned that he “will not allow his family members to apply for State Land”. A week later, we had the notorious scandal of “276 acres MJC State Land sold to a BN crony company at less than 25% of the prevailing market price”. The case is still unresolved.
In the present case, the Government is acquiring private land for BN cronies. Taking the land from the people to benefit the BN cronies.
The term “urban development” is the blanket excuse given by the BN Government to acquire private land for its cronies. Few years back, when the Government attempted to acquire 3000 acres of private land at Bako area for its cronies, it also used “urban development” as the ground of the acquisition. As it was later revealed, that “urban development” includes building condominiums, apartment, commercial centres, etc. by private developer.
Fortunate for the landowners in the Bako area, DAP was gaining strength, especially in the urban area. We won the 2010 Sibu by-elections and we went on to win 12 DUN seats in the subsequent 2011 State Elections. This political pressure ultimately forced the BN Government to cancel the Bako Land acquisition exercise.
In 2016 Sarawak State Elections, DAP suffered severe setback and BN regained some of its lost seats from DAP. 2 months after the DAP’s defeat, BN Government is now back to its “Land for the Cronies” policy.
We call upon Adenan to hold true to his advocacy for clean governance and stop this land-grabbing action.

促阿德南停止“掠地惠朋党”的政策

(古晋22日讯)民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁敦促阿德南停止“掠地惠朋党”的政策。 

张健仁是针对砂州政府最近征收座落在马当KampongGita约142英亩私人地的事件,做出如是发表。

也是砂州民主行动党主席的张健仁表示,这种“掠地惠朋党”的政策,是过去前任首长政府的“专长”,似乎如今阿德南的政府,也开始走回这条“掠地惠朋党”的老路了。

张氏指出,有关马当Kampong Gita的地段,政府总共有3轮的征地行动,即:
1. 2014年5月16日,以“建路”的理由征地;
2. 2014年12月3日,以“城市发展”的理由征地;
3. 2016年6月18日,以“城市发展”的理由征地。

张氏透露,第一轮的政府征地行动(16-5-2014),地主们都没有反对,因为它是为了建路,是为了真正的“公共利益用途”而征地,所以地主们都没有反对。

他说,第二轮的政府征地行动(3-12-2014),涉及132.8英亩的私人地,征地的理由是“城市发展”用途。 虽然征地的官方宣布是于2014年12月就已做出了,但是砂州政府等到2016年7月,将近两年后,才出信通知地主们有关征地的决定。

“这是极不寻常的举动。 为何2014年的征地决定,却拖到2016年7月才出通知信? 难道国阵政府担心它会影响砂国阵在2016年砂州选举国阵的成绩? 因此,等到砂州选举过后才发出通知信告知这些地主们,他们的土地被政府征收了。”

张氏说,第三轮的政府征地行动(18-6-2016),涉及15.44英亩的私人地,征地的理由也是“城市发展”用途。 似乎132.8英亩的地,还是不足以满足国阵朋党的贪焚,要整片148.24英亩的地才足够。

张氏也说,第二和第三轮的政府征地的通知信,是于2016年7月中同时发出。

他也透露,在上星期和土地局的咨询会中,土地局的官员都无法解答,这“城市发展”计划为何物?

“当我问他们这‘城市发展’的计划图在哪里?他们说还没有图。 土地局的官员说,有一些是河岸建设工程,一些是商店和住家的发展工程。”

张健仁表示,发展商店不是政府的工作,尤其是,征收私人土地用以发展商店。 这不是真正的“公共利益用途”。 这是“掠夺人民的土地”。 砂州在过去20年,就是被这种“掠地惠朋党”的政策所迫害。

他说,当阿德南刚刚上任当首长时宣布说他将不允许他的家人申请政府地,人民对他寄以厚望。 但是,一个星期后,就发生古晋石角MJC贱卖267英亩政府地的丑闻。 到目前为止,这案件还悬而未决。

“那267英亩MJC对面的地段的事件,是贱卖政府地。如今Kampong Gita的征地行动是,拿人民的土地,惠朋党。”

“那所谓的‘城市发展计划’的政府征地理由,根本就是国阵在企图合法化掠地惠朋党的不公平政策。”

张氏说,早在几年前,政府欲征收座落在青山岩约3000英亩的私人地,政府所给予的理由也是“城市发展计划”。 之后被暴露,这“城市发展计划”包括给私人发展商建公寓,商业中心等。

张氏指出,在青山岩政府征地的事件中,地主们幸运的是,当时民主行动党的支持率与日增加,尤其是在城市地区。

“我们2010年在诗巫补选胜出。 接着又在2011年砂州选举攻下12个州议席。 这强大的政治力量和压力,致使砂州政府取消青山岩的政府征地行动。 反观目前,2016年5月砂州选举,行动党惨败,国阵赢回几个城市的选区,之后还不到3个月的时间,国阵政府又重新走回‘掠地惠朋党’政策。”

我再次的呼吁阿德南,应履行他刚上任时要实施廉政的豪言,立刻停止掠夺人民土地的政策。

市政局取消刘氏管理权 石角夜市小贩风波再起

(本报古晋20日讯)对于石角新市镇夜市小贩风波,砂民主行动党主席张健仁“挑战”巴达旺市议会主席罗克强澄清两点,即市议会中止夜市管理公司的管理权后,是否计划将管理权交给另外第三方(私人公司),或市议会自己管理﹔以及所谓“目前”市议会没有向约400名小贩征收任何费用,那无征收费用之举的时限是多久?
其今早在有关夜市管理公司业主刘源真陪同下,所召开的新闻发布会上,发表上述言论。
据悉,该区夜市共400个摊位,其中约120个摊位是在刘氏业主管理下长达8年,相关合约属每年更新,而在第八年的更新期改为每6个月,直到今年,市议会致函给刘氏,并在没有给予任何理由情况下,表示在今年6月30日中止其管理权。
张健仁表示,在刘氏管理之下的摊位,每一个摊位一日收费是5令吉,一周2天(即周四及周五),而市议会却在大选过后的今年6月,取消刘氏的管理权。
允许另家公司处理夜市
“实际上在去年3月,市议会尝试要取消刘氏管理权,同时允许另外一家私人公司来处理夜市,包括将夜市从现有地方转移去一个私人地方(还是同一个区域),而当时公布的新收费是每日19令吉,且强制性要小贩经营5天等等,不过那时候引得小贩们抗议,之后市议会就继续由之经营,保持原状。”
“直到今年刘氏再次收到信函,并在中止期后,有非市议会代表的第三方去该夜市进行打扫、划格子及调动小贩等。”
他直言,该区一些小贩非常担心,刘氏管理权被取消之后,权限将转移给别的私人公司,因此,在上周四发起的请愿书签名运动,收集到约130个签名,其中包括刘氏此前所管理的95%小贩签名,要求市议会保持原状,允许刘氏继续管理。
市议会姿态模凌两可
他抨击市议会模凌两可的姿态,并对罗克强指其误导小贩的言论说,“希望不要太低估小贩的智慧,他们不傻,不会如此轻易的被任何人的言论所误导。”
他形容,若小贩没有感到生计被影响,就不会有多达130人写下姓名、身份证号码及摊位号码而签署请愿书。毕竟做夜市生意,最愿意就是与市议会合作。
他质疑,如果市议会没有计划交给第三方私人公司,以后的整洁工作由谁负责?而要接管的第三方虽还未正式露面,不过目前却有实际性管理的举措。
他强调,上述是当地小贩最关注的问题,特别是希望罗克强尊重民意,且请愿书是在刘氏管理之下小贩的意愿;去年也有一份请愿书,但最终不被受理。
同时,刘氏在现场也表明希望市议会给予说明,尤其是收费方面,如果没有对小贩征费,或与目前征费一样或更低,那本身非常乐意将管理权交给市议会接管。

MPP questioned over possible new management for market

KUCHING: The Padawan Municipal Council (MPP) has been questioned on whether it would appoint a new management company for the MJC Batu Kawah Night Market.
State Democratic Action Party (DAP) chairman Chong Chieng Jen called on MPP to clarify the issue.
“If so, what would the management fee be like? Also, MPP, after taking over the management of the hawkers’ market, said it is not collecting fees at the moment. How long will this last before they start collecting fees?” he asked during a press conference yesterday.
He claimed that ever since MPP took over the management of the market, individuals from a private company had been seen cleaning up at the market and even drew space markings for the stalls.
“It seems like a third party is already taking over, even though not officially made known,” Chong claimed.
On Friday, MPP chairman Lo Khere Chiang had stated hawkers could continue to trade as usual and that there would be no change to the fees charged.
“The hawkers would pay exactly the same as what they are paying now, not more, not less,” he said.
Previously MPP collected RM3 out of the RM5 per day charged by the Federal Agricultural Marketing Authority for each stall.
Some 400 hawkers trade at the market every Thursday and Friday.

见证砂选举委员会烧毁圣淘沙区选票

砂州选举委员会昨日正式烧毁圣淘沙区选票,而身为民主行动党哥打圣淘沙区州议员张健仁也亲自前往现场见证。
这项选票销毁工作是于昨午在位于石角德沙威拉的巴达旺园艺处进行,该区选区所有选票,包括邮寄选票一律被烧毁。
“所有的选票在大选后都被封在塑胶袋里,过后,在销毁前才在候选人及选举官的见证下被拆开并即刻烧毁。”

选票绝对是保密的,没有人会知道选民把选票投给谁,因此,张健仁表示国阵过去一直恫言知道选民投票去向的言论根本不成立,选民无需感到担心,更不会因为把投票给谁而受到对付。
在今年5月7日举行的第11届砂州选举,来自民主行动党的张健仁以2819张多数票击败人联党候选人叶耀星,张健仁共获得1万0047张选票。

砂拉越 新改良《火箭报》

砂拉越民主行动党今日推介砂拉越版的火箭报,将其内容加入更多砂拉越元素以及更多的砂拉越新闻。这将使得砂拉越人民不单单可以获得全国课题的汇报,而且更能够更加的、仔细的了解砂拉越地方性的课题。今日出席推介礼的砂拉越行动党众领袖包括了该党砂州主席张健仁。
张健仁表示,在国阵的执政底下,这几十年来马来西亚的媒体自由度每况愈下,特别是近年来更加是变本加厉。根据近年来的数据显示,马来西亚的媒体自由度差强人意,被评论为“媒体不自由的国家”。
“我们可以清楚地看到在今年的刚过去的砂州选举时期,砂拉越国阵政府控制媒体的手段更加的严重,无论是平面媒体或是电台都被指示,有特定的模式来包装砂国阵领袖。而且在网络媒体方面,砂国阵更是雇佣了庞大的网络打手来污蔑并且散播许多针对行动党的不实以及毫无根据的指控。甚至我们许多的候选人及领袖在州选举期间,电话号码也被盗用以散播不确实的言论。”
“民主行动党面对这样庞大的金钱及机制的打压,我们仍然要坚守我们的岗位,那就是要向民众传达事实。这事实是根据证据及理据。马来西亚人民不应该再继续被谎言所蒙蔽,马来西亚人民有绝对的知情权,特别是针对国阵政府如何盗窃国家资产。”
因此张健仁表示,在种种国阵谎言的掩盖下,砂拉越民主行动党必须从这种困境中给予一盏明灯,那就是透过新改良版的火箭报,给予人民最真实的报导。因此民主行动党希望各界人士继续的鼎力支持火箭报,使火箭报能够继续生存,特别是面对百物高涨的时候,火箭报的生存更艰难。
新改良版的火箭报依然是售价3令吉,并且由民主行动党各区的领袖以及党员负责兜售。今天所推介的第一期砂拉越版火箭报将会向砂拉越人民揭发国阵砂州选举前和选举后“大变脸”的十大例子。此外,张健仁也表示,火箭报也在研究推行电子报的可能性,以促使火箭报的阅读率可以更加的广泛。

张健仁:未有具体计划 州政府征地颠倒秩序

(本报古晋16日讯)州政府以《砂州土地法典第48条文》为由,以1英亩38万4500令吉的价格征收总共170英亩的土地。涉及的数十名地主于今日在砂行动党主席张健仁的陪同下,出席土地测量局的听证会。会议的结果是地主在两个星期内呈上土地估价报告。
行动党国州议员张健仁披露,实际涉及人数超过百名地主,政府仅以“城市发展”的笼统字眼为由,向马当区甘榜吉达的地主征地。
征地后转由私人发展商
他表示,惟今日在听证会上提出问题时,他发现所征收的土地暂未有任何具体的发展计画,只透露一部分或会用于兴建河滨公园,而其余的部分则用于兴建商业店屋。
他认为,这明显透露出州政府征地的目的是为了把土地征收后,再转由私人发展商去做商业发展。
“因为政府不可能进行商业店屋的发展,这也不是政府的责任,而且政府也从来没有进行过这类的发展。至于是哪一家私人发展商?我们将继续追究。”
赔偿远低于市价
他提到,政府所给予的征地赔偿远低于一般市价,地主纷纷认为该地段至少值1英亩200万令吉的价格,因为该沿河地段只要一过桥之后,即能通往古晋中华小学第六校地区,而六小附近的土地一般上价值介于200万至300万令吉之间。
他续说,甚至一名地主还坦言,本身于2014年被开出以1英亩400万令吉的收购价格,却果地主还拒绝了有关开价,如今政府却只以1英亩38万4500令吉的低价征地,实为不公平。
张健仁认为,政府在没有详细的发展计画下,就向地主征地,根本就是颠倒了秩序。政府理应在计画之后,才向相关的地主要求征地,而不是一律的征收所有土地,不管该地段是否涉及发展计画。
他是于今日陪同涉及地主出席听证会,与土地测量局主管会面后,召开新闻发布会时,如是说道。
时隔逾1年才发函
他说,该案件更有另一疑点,即征地的宪报是于2014年12月3日出示,但该局却迟迟没有发函给地主。一般上,在《砂州土地法典第48条文》之下的宪报﹐会于1至2个月内就发函,但令人不解的是,政府直至2016年7月才发函。
“唯一能够解释的就是,当时要面对一场选举,因此才拖到州选完毕之后,才告知地主他们的土地被政府征收了,所以地主完全不知情﹐原来在2014年,政府早已有意要征收他们的土地。”
他表示,土地测量局在听证会后,限地主们在2个星期内呈交估价报告。他声称,目前涉及的地主正在考虑起诉州政府征地的决定,以及征地所赔偿的低价数目,起诉州政府赔偿不足。

管理费暴增 定营业天数 夜市小贩怒吼

(本报古晋15日讯)石角新市镇的夜市迁移风波又卷土重来!不仅要小贩们一个星期至少营业5天,管理费也暴增3倍之多。巴达旺市议会怎么可以纵容如此不合理的管理收费?
哥打圣淘沙州议员张健仁今日召开新闻发布会表示,巴达旺市议会于去年初突然终止FAMA和Triple S Enterprise对石角新市镇夜市的管理权。同时,将管理权转交给另一家私人公司。而该私人公司立刻强迫性的告知夜市的小贩们,要迁到石角新市镇商业中心中间的空地广场,收费则暴增至每天19令吉,而小贩们也必须一星期摆摊至少5天。
每天收费19元
他说,由于条件苛刻(强逼性必须一星期营业5天)以及太昂贵的收费(一天19令吉),许多小贩都拒绝迁进该公司所指定的地点。
他披露,FAMA作为一个官方机构,接受巴达旺市议会的终止信,即把管理权交回给巴达旺市议会。但是,Triple S Enterprise业主和负责人刘源真则带领小贩们和巴达旺市议会周旋。
他指出,虽然一些小贩接受巴达旺市议会所指定的新的公司,搬进新地点营业,但是经过一段时日,因为昂贵的收费,无法维持而又回到Triple S Enterprise所管理的地点营业。
州选后再出信
他称,由于当时砂州选举的迫近,巴达旺市议会不敢用强硬手段逼小贩们接受新的私人公司管理。事情拖到今年,5月砂州选举过后,人联党在石角胜出,而罗克强也在峇都吉当胜选。巴达旺市议会就在今年6月,再度的出信终止刘源真管理MJC夜市的权力。
他披露,他本身于上星期四在刘源真的陪同下,与石角新市镇夜市的小贩们交流后发现,大部分的小贩对刘源真的管理有信心,并感到满意。因为,长期来,由刘源真所管理的那大约120位小贩摊主,都很顺利的营业,没有什么冲突。
他说,最令石角新市镇夜市小贩们担心的问题是,市议会有前车之鉴,接管夜市的管理权之后,再将它私营化,承包给另一个私人公司,而新管理公司的收费和条件更是令小贩们吃不消。
“另外,许多MJC夜市的小贩,他们除了于每星期的星期四和星期五在MJC夜市摆摊之外,也于其他日子在别处摆摊补贴生计。有者更是已进入退休年龄,只做2天生意赚点零用钱过活。他们无法符合新管理公司所规定的‘每星期必须营业5天’的条件。”
“这些小贩对于罗克强如今如此强硬的态度感到费解。是否是因为州选时,有一群小贩公开支持有联民党背景的独立人士刘天亮,而使罗克强恼羞成怒,如今变脸?还是原本就要给那新公司赚‘大钱’,但之前是为了应付州选而暂时搁置,如今州选过了,人联党也赢了,就可以为所欲为?”
理应减低收费
他质问巴达旺市议会和主席罗克强,巴达旺市议会接管这石角新市镇夜市的管理权,有何用意?市议会是否将自己继续管理抑或是将另行承包给另一家私人公司?
另外,他也要问巴达旺市议会,在接管这石角新市镇夜市的管理权后,是否仍保留现有的营业条件,即一天5令吉的收费率?
“既然巴达旺市议会接管,市议会应该征收更低的收费率。如果市议会接管之后,收费率保留原来的5令吉或更贵,那就失去意义,倒不如继续由刘先生继续管理。”
“如果巴达旺市议会有意要另外委任别家私人公司承包该夜市的管理权,那新管理公司的条件是什么?”
把小贩当人球
他说,小贩们虽然不是什么有权有势的人物,但是,市议会在做任何会影响他们生计的决定前,应该尊重他们的意愿,谘询他们的观点。巴达旺市议会不应该把小贩当人球,踢来踢去,当需要带旺一个地区时,就叫他们去营业,当一个地区开始有点旺的时候就来刁难他们。
同时,他认为,罗克强也应学习尊重人民的意愿。7哩市镇的交通,就是因为罗克强一意孤行,不听民意,而搞到一团糟,也越弄越乱,塞车情况也没获得改善。如今,石角新市镇夜市的运作,将影响几百个家庭的生计,他身为巴达旺市议会主席兼州议员,应以人民的生计和利益为优先。
影响数百家庭
石角新市镇夜市自2008年开始营业至今,营业时间是每逢星期四和星期五。当初是为了带旺石角新市镇而开始了一星期两天的夜市。当时,巴达旺市议会就委任Triple S Enterprise来管理夜市里大约一半的摊位(约120个摊位),另一半的摊位则是由FAMA来管理(约250个摊位)。
FAMA向其管理的小贩们征收每天6令吉的收费,而刘先生则收每天5令吉的费用。这些费用包括还巴达旺市议会的清理费和倒垃圾的费用。

MPP now managing MJC hawkers’ market

KUCHING: Padawan Municipal Council (MPP) has taken over the management of the popular hawkers’ market taking place every Thursday and Friday at the MJC Batu Kawa New Township here.
Its chairman Lo Khere Chiang said this took effect since end of June which means other companies do not have the right to collect fees from the hawkers anymore as what it used to be before this.
He confirmed MPP has sent a notice to terminate the services of a company which previously managed the market, which is located side by side to the farmers’ market previously managed by Federal Agricultural Marketing Authority (FAMA).
Since the decision has been made, he called on others especially opposition parties not turn the issue into their political agenda but to respect MPP’s decision.
“We no longer require the service (of that company). It has nothing to do with charges, we have terminated his (the company’s proprietor) services. He has no right to collect fees or have any dealing with the hawker centre, and no right to interfere with the management of the hawker centre.
“The fact is that the council has taken over the management of the market. This was decided during the council meeting, it was not my decision alone,” he said when contacted yesterday.
Lo was asked to respond to allegations made by DAP Sarawak chairman Chong Chieng Jen that MPP had been unfair in terminating the services of Triple S Marketing which previously managed the market.
According to him again, the hawkers there can continue to trade in the usual manner but they are only answerable to MPP and not to Triple S Enterprise.
“The management of this market is now completely under MPP, no other company. The council will charge the fees accordingly including for the license and charges for cleaning up the area,” said Lo, who was elected as Batu Kitang assemblyman in the recent state election.
Earlier at a press conference held at DAP Sarawak headquarters, Chong and the Triple S Enterprise proprietor Liew Ngian Chin questioned the motive for MPP to take over the management of the market.
They said the market has made MJC a more vibrant place since Triple S Enterprise managed it in the past 10 years, but MJC decided to take over just when the market is becoming very popular.
Chong told reporters that based on a dialogue session with the hawkers last Thursday, most of these hawkers are happy with Triple S Marketing which charged only RM5 per day.
He said there were 120 hawkers who were managed under Triple S Marketing, while there were 250 hawkers previously under FAMA.
He also said that the hawkers were worried that the charges would be higher and they would be forced to trade more than two days per week, as what was imposed on them when a company appointed by MPP charged them RM19 per day and told them to trade five days a week at a relocated site last year.
“My question to MPP and its chairman Lo is this – What is the purpose of MPP taking over the management, and is MPP going to manage or sub contract it to another company?
“What will happen when MPP takes over the management? Is it going to maintain at RM5 per day or is it going to be increased like what happened in last year’s attempted takeover? If MPP takes over, they should reduce the rates or otherwise this loses the purpose.
“In my view, when MPP makes decision affecting the hawkers, MPP should respect their wishes and consult them even though these hawkers are not rich and powerful,” said Chong.
Chong also alleged that the MPP’s decision was out of revenge due to some of the hawkers openly supported Liu Thian Leong, who stood as independent candidate in Batu Kawa state seat in the recent state election.
Lo is from SUPP, while party president Datuk Dr Sim Kui Hian won the Batu Kawa seat by wresting the seat back from DAP in a three-cornered contest.
Based on previous news reports, Liu – who was formerly UPP Batu Kawa chairman – had been actively helping these hawkers and was instrumental in enabling them to continue trading at the present site. Liu quit the party to contest as an independent candidate in Batu Kawa.

政府征收私人地,是未有发展计划还是朋党互利计划?

(古晋13日讯)民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁回应砂土地局,“未来城市发展”的征地理由,也即是说,目前还未有什么发展计划,或是目前有一些不可告人的“朋党互利计划”。

昨日,砂土地局发文告解释有关政府征收约100英亩坐落在Kampong Gita的私人地,是供未来的“城市发展”用途。

张健仁指出,“城市发展”是一个非常笼统的字眼。 它涵盖任何形式的发展。 更甚的是,在《土地法典》之下,它包括任何“首席部长认为对砂州经济或社会有益的用途”,而且可以由“任何人、公司或政府机构”去进行。

张氏说,根据砂州《土地法典》这种不公平笼统定义,这所谓的“城市发展”的公共用途,也包括给朋党或私人发展商建房屋、商店、高楼等,谋私利。

他说,如果政府是真的有什么公共用途的发展计划如,建学校、医院等,那它应该公布这些计划的详细资料。 如果这所谓的“城市发展”是给国阵的朋党做房屋和商业发展,那不是真的“城市发展”,而是‘掠地惠朋党’的发展,也即是在滥用政府征地的权力。

“土地局应该坦白的告诉这些地主,其所谓的‘城市发展’到底是什么发展,而非含含糊糊的以这个笼统的字眼为藉口,低价收购人民的土地。”

张氏也指出,过去,砂州政府也是以“城市发展”欲征收青山岩约3000英亩的私人土地。 结果,当地主们和行动党大力反对该项征地行动之后,终于暴露出,原来那所谓的“城市发展”根本就是要把私人地收回然后给国阵朋党公司去做商业发展,以赚取私利。

“当时,因为涉及的人数太多,而又恰逢2010年诗巫补选和2011年砂州选举,砂州政府最终被迫取消该征地行动,把地还给地主们。 如今,事隔6年,当国阵认为人民对它的支持率略有回流和增加之后,是否又再重蹈覆辙的开始其‘掠夺民地,自肥朋党’的暴政了?”

张氏透露,他于前日与数位收到土地局征地通知书的地主们交流,他们对于有关征地的不满,主要是:


1. 政府征地的价格,虽然是按照有关土地的市价,但根据《土地法典》的定义,政府征地所给予赔偿的市价的估价考量,不包括政府在征地7年内所建设的道路和水电供应的设施。 换言之,虽然目前该区有道路和桥梁建设,但政府赔偿的市价,将不会考虑有关土地有道路和桥梁存在的因素。 这是极不合理的征地赔偿计算方程式。


2. 就算是真的政府有什么“城市发展”计划,他们身为地主,应该获允许参与该发展计划并从中受惠。 但若此次的政府征地成功,那无论什么发展计划,他们身为地主的,都无缘受惠。


3. 更何况,到目前为止,土地局都无法道出那所谓的“城市发展”为何物。 由此可见,这根本就是和前朝政府类似青山岩的“掠地”行为没有两样。 似乎,虽然阿德南取代了泰益为首长,但国阵的‘利朋党’政策却没有改变。

张健仁表示,虽然这次的征地行动只是涉及约100英亩地,但若这掠地种运作模式成功,国阵将食髓知味的继续仿效如此模式去进行其他地区的掠地计划。

“这个征地行动只是一个开始和尝试。 若它成功而不多人大力抗议的话,今后我们任何人的土地都会以同样的方式被国阵政府征收,人民在土地的投资也就没有保障。”

张健仁表示他将和实丹宾国会议员的国会研究员俞利文,陪同这些地主们于本月16日及17日,出席土地局的会议,为他们请命,替他们争取。

Urban Development has no immediate concrete plan to develop the land to be acquired

The so-called “urban development” excuse given by the Land and Survey Depatment for the acquisition of the land near Kampong Gita area just goes to show that the Government either:
1. has no immediate concrete plan to develop the land to be acquired; or
2. after the acquisition, to alienate the land concerned to some third-party for development for private profit, which is why the L & S cannot disclose the exact reason for acquisition of the said land.
For the L & S to give the reason of “urban development” as the ground of the “public purpose” to acquire the approximately 100 acres of land near Kampong Gita area, that is most vague and unfair to the landowners.
Under the present Land Code, the word “public purpose” include any development which in the opinion of the Chief Minister will bring economic or social benefits to the state and that such development can be carried out by any person, corporate or government agencies.
In another word, under the present Land Code, land can be acquired by Government and subsequently given to a third party, a private person or company for development into residential or commercial property for private profits. This is most unfair.
I challenge the L & S to state the exact purpose for which these land are acquired, and not to give such a vague term as “urban development” to justify your land-grab action.
if you have any plan for development for REAL public purpose like building hospitals or schools, then make known such purpose. If this acquisition is so that the Government will later alienate the land to some BN cronies for private profits, then this is an abuse of the power of the Government to acquire land.
In fact, few years back, the Government attempted to acquire about 3000 acres of land in the Jalan Bako, Kuching area, also under the excuse of “urban development”. After huge protest by the landowners together with DAP representatives, it was exposed that the so-called “urban development” was for the BN cronies to build commercial and residential buildings for private profits.
At that time, the number of landowners were large and the issue was exposed and pressed very hard during the 2010 Sibu by-elections and 2011 Sarawak Elections. At the end, the Government, under pressure, cancelled the said acquisition and return the land to the landowners.
Two days ago at my office, the Parliament Research Assistant of MP for Stampin, Kelvin Yii and I met up with a few landowners of the land in Kampong Gita under the said acquisition exercise. Their main dissatisfaction are:
1. the low compensation provided under the Land Code for the acquisition of their land. Although under the Land Code, it is provided that the compensation must be based on “market value”, but under the Land Code, in determining the market value for land acquisition, one must disregard the enhancement of value due to roads or utilities constructed within 7 years from the date of the said acquisition.
In other words, though there are currently roads and bridge to be built in the area, such infrastructures must be disregarded when assessing the market value of the land to be acquired.
This is most unfair.
2. If there is truly some “urban development” by the Government on their land, they, as the landowners, should be allowed to participate and benefit from the said “urban development”. With the acquisition exercise, they are deprived of any benefits from the said “urban development”.
3. Until now, the L & S still cannot tell us or dare not tell us what the “urban development” is all about. Is it similar to the “Bako land” acquisition under the Taib’s administration? If so, it seems that there is no change in the “pro-cronies” policy of BN, be it Taib or Adenan as the Chief Minister.
Although the present acquisition only affects approximately 100 acres of land, if there is no strong opposition to such acquisition exercise, this modus operandi of “land-grabbing” will be repeated and emulated for land in other areas.
The present land acquisition is but a test of resistance. We should not allow it to go through, otherwise, all our land rights will be subject to such land-grabbing in future.
Together with the landowners, Kelvin Yii, and I will attend the inquiry to be held by the L & S on 16th and 17th this month. We will put forth our objection to the said acquisition.

叶耀星报章做宣传 自己投诉自己失职


(古晋11日讯)民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁对于人联党叶耀星日前上报投诉巴达旺市议会失职的行为,感到可笑。

人联党公共投诉主任叶耀星于昨日报章上大事宣传他协助处理居民投诉5里八港路第10巷因有位地主进行土地填土的工程而弄到路面黄泥铺路。 叶氏也在报章上大事宣传他的人联党投诉局的身份,如何的有效协助解决人民的投诉。

张氏指出,叶耀星在报章上所处理的问题,是因为巴达旺市议会的失职所造成的。 

张氏揶揄,叶耀星似乎忘记其本身就是巴达旺市议会的市议员之一,而人联党的州议员罗克强也就是巴达旺市议会的主席。 叶耀星的上报宣传,是在告诉全古晋人一个非常荒谬也极讽刺的事实,即:
“巴达旺市议员的叶耀星失职没有处理好民生问题,人联党投诉局的叶耀星就发挥其投诉局的作用,向巴达旺市议员的叶耀星投诉。 结果,巴达旺市议会处理了这民生问题,人联党的叶耀星成功向巴达旺市议员的叶耀星反映民生投诉,解决民困。”

张氏讽刺,叶耀星在上报做宣传时,似乎忘了自己也是巴达旺市议会的市议员之一。 自己向自己投诉自己的失职,这也算是为民请命,也只有人联党的领袖想得出这种歪论。

“处理自己本身失职所造成的问题当做是为民服务而大事在报章上做宣传,除了自曝其短,更是马不知脸长,不知羞耻。”

张健仁透露,叶耀星这项举动更令人发指的是,其实,早在今年7月28日,张健仁就已向砂州政府的投诉总站talikhidmat投诉有关5里八港路黄泥铺路的事件。 而当天就已获得talikhidmat电邮回覆将联络有关部门处理。

张健仁今日在记者会上出示他于今年7月28日电邮砂州政府的投诉总站talikhidmat的记录。 他电邮中投诉有关5里八港路因第10巷的地主填泥工程而弄到到八港路黄泥铺路。 他在电邮中也提及该月27日因为路面有黄泥造,一场雨后该段路非常滑而酿成车祸,导致两位驾车人士严重受伤。

“我在电邮中也提到,该区的居民已针对这工程致使黄泥铺路的事件向巴达旺市议会投诉,但非常遗憾的是,巴达旺市议会却没有采取行动。”

张氏表示,通常他通过talikhidmat的民生投诉,在一星期之内就会获得解决。 尤其是承包商弄脏路面这类投诉,市议会的一、两位执法官员只需去到工地现场,事情就可解决了。 如今八港路的这项投诉,却会拖到两星期后才获得解决,而且还是有车祸发生之后两个星期。 

张氏质疑为何巴达旺市议会对于这项投诉如此拖时间,缓慢处理。 

“难道巴达旺市议会要等到叶耀星宣誓蝉联市议员后,有空去八港路‘一游拍照’才肯采取行动? 为了要让叶耀星有机会上报,八港路居民却被逼多受‘黄泥路’之苦一个星期。

In Petronas’ press statement issued yesterday, Petronas claims that:
“ Key to the successful delivery and operations of PETRONAS’ projects in the State is the support and commitment from all relevant parties, most important of whom are PETRONAS’ teams of qualified, trained and dedicated employees – no matter where they are from.” 

Is Petronas saying that Sarawak has no qualified, trained and dedicated employees to fill up the top and middle executive level positions in Petronas’ Sarawak Operation? This is surely untrue and an insult to Sarawakians. 

There are more than enough qualified, trained and dedicated Sarawakians to take up the top and middle management level positions in Petronas’ Sarawak operation. However, we are not given the opportunities in Petronas.

The issue of giving more job opportunities to Sarawakians has been agreed to between Petronas and Adenan since November, 2014. It was also so reported by Adenan in the November 2014 Sarawak DUN sitting. 

However, more than 20 months have passed, yet only 39% of the management positions and 46% of the middle management positions are filled by Sarawakians in Petronas’s operation in Sarawak. Such statistics surely do not reveal any effort on the part of Petronas to give more job opportunities to Sarawakians, unless Petronas is only referring to lower rung positions.

The Petronas’ press statement seems to make it clear that it will defend such composition at its management and middle management positions in Sarawak. The question, therefore, is: 
In this standoff, whether the State Government is going to give in to Petronas and the power that be in Putrajaya?

Furthermore, the State Government should not be merely imposing a freeze on the new work permits application for Petronas employees in Sarawak but commence the revocation of the existing work permits of Petronas’ top and middle management in its Sarawak Operation towards the target of 70% local Sarawakians in both the top and middle management level of Petronas’ operation in Sarawak.

This is a test of the Sarawak State Government’s priorities, ie. whether Sarawakians’ interest comes first, or the wishes of Putrajaya & Petronas come first.

行使砂移民自主权 保障砂人民利益

(古晋8日讯)民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁呼吁砂州政府行使砂州移民自主权,以确保国油集团在砂州的营业和运作,增聘砂州子女。
张健仁指出,早在2014年11月,阿德南在砂州议会做总结时,告知州议会,国油已同意在人力资源发展及教育方面,将确保有更多的砂州人参与其在砂州的营业运作。
张氏表示遗憾,1年又8个月已过去了,国油在砂州的营业运作上,还是没有给予砂州子女任何的特别优待。 根据最近所透露的数字,国油集团在砂州的各个营业中,高级管理层的雇员中只有区区的39%是砂州人,而中级管理层的雇员中,砂州人也只占了46%。
张氏说,但是,当国油要进行公司改组,其许多有经验的砂州员工,却被辞退,也不被给予机会到另外的部门继续工作。
“看来,阿德南在报章所讲的话,还有砂州议会的议决案,联邦国阵政府根本就不当一回事。 我们拿不回20%的石油天然气开采税。 国油给予砂州子民的在其砂州营业的就业机会也没有明显的增加。”
张氏也说,砂州政府应该要以急迫感,因为砂州的石油储量也日益减少。再过20年,砂州也没有石油了。 到时才来争取,为时已晚。
他指出,所有那些在国油的砂州营业运作做工的西马人,要进入砂拉越,都必须事先得到砂州政府所发出的移民和工作准证。 既然联邦政府如此漠视砂州议会的议决,砂州政府应该暂时吊销这些人的移民和工作准证。
“阿德南在州选时,就能够为了国阵的利益,禁止多名反对党的领袖进入砂拉越。 那为何他不能使用同样的移民自主权,来保障砂州人民的利益。 难道移民自主权,只是用来保护国阵,而非用来保护砂州人民?”
张氏呼吁砂州政府设定70%的目标给国油,限定国油在砂州的营业,各层次的员工,砂州人应占至少70%。 在国油达到这目标之前,国油在砂州全体的西马职员的移民和工作准证暂时被吊销,至到国油能符合这目标。
张氏说,既然砂州有移民自主权,那州政府就应该好好利用这移民自主权来保护砂州人民,而不是,只是用这项自主权来保护砂州国阵和他们的朋党。

DAP Urged Adenan to Use Immigration Power to Ensure Greater Sarawakian Participation in PETRONAS’ Management in Sarawak

As early as November, 2014 in Sarawak DUN, Adenan informed the DUN that Petronas has agreed for more Sarawak participation in terms of human resource, education and technical training. 

Yet, when it comes to employment by Petronas for its operations in Sarawak, Sarawakians are still not given the priority. 

One year and 8 months have passed since Adenan’s announcement in DUN, majority of the senior posts in Petronas’s operation in Sarawak are still filled by non-Sarawakians. In the statistics recently disclosed, only 39% of the management positions and 46% of the middle management positions are filled by Sarawakians in Petronas’s operation in Sarawak.

On the other hand, when it comes to Petronas’s restructuring exercise, Petronas is quick to retrench experienced Sarawakian workers without giving consideration for re-deployment of these workers to other jobs within the Petronas Group. 

It seems that despite the repeated calls of Adenan and the resolution passed in Sarawak DUN in May, 2014, the Federal BN Government is still adamant in keeping to itself, the major chunk of the benefits derived from the petroleum production in Sarawak.

We did not get the 20% Oil and Gas Royalties. The number of Sarawakian employed by the Petronas for its operations in Sarawak, especially at the managerial and middle managerial levels, still leaves much to be desire.

Given the depleting oil reserves, the clock is ticking against Sarawak in general. Adenan and the State BN Government should not wait till such time when there is no more oil reserves in Sarawak before they really assert the State’s rights.

For all those West Malaysian holding positions in Petronas’ operation in Sarawak, they require immigration and work permits to enter Sarawak. The power to issue work permits and immigration permits lie within the sole power of the State Government.

Since Petronas and the Federal Government is paying no heed to the Sarawak DUN’s resolution, the State Government should withhold these work and immigration permits to prohibit the Petronas’ management and middle management level employees from entering Sarawak.

When the State Government can be quick to ban the entry of Opposition politicians from entering Sarawak during the State Elections to protect the BN’s interest, there is no reason why such powers cannot be exercised to protect the interests of Sarawakians in general when it comes to job opportunities for locals. 

DAP call upon the State Government to insist on a target of at least 70% of the management and middle management level in Petronas’ operation in Sarawak to be Sarawakians. DAP further calls upon the State Government to revoke the work and entry permits of the present Petronas management and middle management West Malaysian employees until such time when the target is reached.

It is only by imposing such strong action that we can get Petronas to accede to our request for more opportunities to be given to Sarawak. Otherwise, all Adenan’s talks about protecting Sarawakians’ interests will come to naught, as shown in the 20% Oil and Gas Royalties demand.
