张健仁﹕停止“进口”外劳 砂政府须捍卫砂民利益

(本报古晋31日讯)在政府当局即将引进孟加拉外劳到砂州从事油棕种植业的课题上﹐砂州政府应该优先考虑到砂州人民的利益课题﹐并将砂州人民的利益放在油棕种植公司的利益之上。
砂行动党主席张健仁国州议员是在今午于该党总部召开的新闻发布会上发言时﹐针对砂州子民阵线就政府当局即将引进孟加拉外劳到砂州从事油棕种植业的事项进行和平请愿活动一事﹐如是表示。
他说﹐其本身曾经在上一次的州立法会议中提出有关课题﹐并曾向砂州政府做出停止“进口”外劳的呼吁。
“唯砂州政府当时依旧决定引进外劳﹐并让他们与砂州人民竞争就业的机会。”
他认为说﹐相关阵线已经就政府当局即将引进孟加拉外劳到砂州从事油棕种植业的事项表明了明确的立场﹐所以他希望砂州政府能够听取砂州本土人民所发出的心声。
“身为砂州人民所选出来的民选政府﹐砂州政府必须捍卫砂州人民的利益。”
他也说明﹐油棕种植公司其实拥有可观的利润﹐所以有关公司应该透过提高薪金之举来吸引本地人民从事油棕种植工作。
他更指出﹐引进廉价外劳之举﹐将只会让本地的油棕种植公司从中受惠。
他也趁机呼吁砂州政府优先考虑到砂州人民的利益课题﹐并将砂州人民的利益放在油棕种植公司的利益之上。

收集居民签名支持 捍卫锡盖族习俗地权益

(本报古晋31日讯)砂行动党将在石隆门锡盖地区进行一项签名运动﹐以期从中收集当地居民的签名支持﹐进而共同捍卫当地居民的土著习俗地权益。
砂行动党主席张健仁国州议员是在今午于该党总部召开的新闻发布会上发言时﹐如是表示。
他说﹐砂行动党将进行一项签名运动﹐以收集锡盖地区居民的签名﹐进而从中共同捍卫当地人民的土著习俗地权益。
“当地社群约由2000到3000户家庭组成﹐并拥有近万人口﹐所以我们希望能够成功收集当地1000个居民的签名。”
他也透露﹐该党认为﹐锡盖地区的土地测量工作﹐必须以更正确﹑透明的方式来进行。
锡盖社群拥30%土地
与此同时﹐石隆门锡盖土地委员会主席兼砂行动党碧湖支部署理主席多美尼则在会上说明﹐该委员会乃成立于2009年﹐并旨在保护锡盖土著习俗地。
“自我们的社群祖先开始在当地居住时﹐当地就被种上了果树﹐所以锡盖土著习俗地的范围﹐就占据了大约1万2000英亩的面积。”
他续称﹐该片土地曾经于1977年3月3日在664宪报通知书下﹐被宪报为政府保留地。
他也披露﹐在锡盖土地委员会于2009年做出申请后﹐有关宪报规定就在2010年被撤销。
“是项宪报撤销之举也意味说﹐锡盖地区内12个甘榜的居民﹐将拥有当地的土著习俗权益。”
唯他指出﹐虽然当地正在进行土地测量的程序﹐唯有关程序的进行﹐将导致锡盖社群只拥有该片土地中的30%土地。
“另外的70%土地﹐则将归还给砂州政府。”
不支持土地测量工作
他因此表示﹐锡盖当地人民绝不支持是项土地测量工作的进行。
“这是因为﹐它意味要拿走我们的土著习俗地。”
他不忘强调﹐唯有在该片面积为1万2000英亩的土地均归入锡盖土著习俗地范围的前提下﹐当地人民才会同意土地测量工作的进行。
较后时﹐砂行动党也在会上推介由该党党员汤姆斯德贡拉卡所制作的录影光碟﹐并宣布将以每片6令吉的价格来发售有关光碟。
该党相信﹐是片光碟将能够让达雅民众了解为何要加入砂行动党的理由。
有关光碟﹐将可在该党各大支部购得。

Villagers fume over alleged 'surrender' of NCR land

Some 10,000 villagers from 12 villages in the Singai area in Bau have expressed their anger against their elected representative, Tasik Biru state assemblyperson Peter Nansian, who allegedly “surrendered” 70 percent of their 12,000-acre native customary rights (NCR) land to the state government.

According to Dominic Daon, a resident of one of the villages, he heard Nansian telling villagers that he had agreed to the government carrying out a perimeter survey by the Land and Survey Department.

Nansian (left) is Parti Tenaga Rakyat Sarawak (Teras) deputy president and assistant minister for community services and industrial development.

"Now the people are angry with him after knowing that 70 percent (or 8,400 acres) of the land will be reverted to the state government as state land," said Daon at a press conference at the Kuching DAP headquarters this morning.

"What is left, is 3,600 acres to be shared by 10,000 people."

The villagers had farmed, cultivated and planted their NCR land with fruit trees since living in the area, Daon added.

He further said that the villagers had formed the Singai land committee in 2009 - with its purpose to protect the Singai customary rights land.

The committee is against the proposed Singai perimeter survey undertaken by the Land and Survey Department - covering areas along the slope of Matang range right to Kampung Apar, Singai.

The land was gazetted under the Gazetted Notification 664 on March 3, 1977, but due to the villagers’ strong opposition and the Singai land committee in 2009, the gazette notification was revoked in 2010.

'Rightful claimants'

"Thus upon revocation, it has been recognised that the residents of the 12 villagers are the rightful claimants of the NCR land.

"But now, the land is undergoing another perimeter survey and with this survey, about 30 percent of the 12,000 acres belong to the Singai community, while 70 percent (or 8,400 acres) of the land will be reverted to the state government," Daon pointed out.

He said that the villagers have totally rejected the proposed perimeter survey, as it meant to take away their NCR land.

"We only allow the perimeter survey to be carried out (if it) includes the whole 12,000 acres as Singai NCR land," Daon added, urging the government to conduct a proper perimeter survey over the whole area - as previously held in the Gazette Notification 664 and thereafter documents of title - issued to the Singai community.

He held Nansian wholly responsible for the villagers' dilemma, as the latter had allegedly agreed with the perimeter survey conducted by the government.

Meanwhile, Sarawak DAP chief Chong Chieng Jen (right) - who was present at the press conference - said that the DAP Mas Gading division would carry out a signature campaign against the conduct of the perimeter survey by the Land and Survey Department.

Daon and Mordi Bimol of the DAP Mas Gading service centre had been appointed to carry out the signature campaign, he added.

Chong - who is the Bandar Kuching MP and state assemblyperson for Kota Sentosa - described the government's action as an “abuse of power”.

"You can say it is a daylight robbery," he noted.

What worried Chong was once the area had been declared state land, crony companies would then apply for the land.

"This is the standard practice of the state BN government," he said.

张健仁﹕避免商家牟取暴利 应废除白糖进口准证

(本报古晋29日讯)政府当局应该废除白糖进口准证制度﹐以让商家可以自由进口白糖﹐进而让我国的白糖市场价格可处于每公斤约2令吉10仙的水平。
砂行动党主席张健仁国州议员是在今早于该党总部召开的新闻发布会上发言时﹐如是做出建议。
他说﹐虽然马币贬值﹐但我国的白糖进口商就算以每公斤介于2令吉到2令吉10仙的价格来售卖白糖﹐也将还是可以赚取利润的。
“唯﹐我国当前的白糖市场售价﹐却是处于每公斤2令吉80仙的水平。”
他也披露﹐贸消当局目前正在反暴利行动下﹐积极展开相关取缔行动﹐以对付该些赚取暴利的不良商家。
但他认为﹐该些拥有进口准证的白糖进口商﹐才是在牟取暴利﹑危害大众利益的一群。
“我不同意商家坐地起价﹑牟取暴利的行为﹐但我还是认为说﹐在进行取缔方面﹐贸消当局人员应该要身体力行﹐对付该些真正在牟取暴利的人。”
他更建议说﹐政府当局应该废除白糖进口准证制度﹐以让商家可以自由进口白糖﹐进而让我国的白糖市场价格可处于每公斤约2令吉10仙的水平。

MACC to probe Batu Kawah land deal

The Malaysian Anti-Corruption Commission (MACC) has assured Sarawak DAP it is investigating the Batu Kawah land deal which was alienated by the state government to a private company at far below market price.

Revealing this at a media conference in Kuching today, state DAP chief Chong Chieng Jen said that he had received a letter from MACC that it would look into the complaints following documents submitted by him on Jan 14, 2015.

The MACC letter, dated Jan 21, addressed to Chong said its Information Review Committee, after a meeting, made the decision to follow up on the complaint.

Chong who is the Bandar Kuching MP for and Kota Sentosa assemblyperson, called on the state government to freeze the land deal while waiting for the outcome of the investigation.

The 267.15 acres of state land, valued at the market price of RM500 million, was alienated to the private company at RM115 million.

The agreement was entered into on Mar 8, 2014, eight days after Adenan Satem became chief minister of Sarawak.

'Freeze the land deal'

Chong said the land deal was Adenan’s  “first test” to uphold the integrity pledge he had signed.

“If Adenan really meant what he had pledged by signing the ‘integrity pledge’ then he should freeze the land deal and even revoke the agreement.

“Moreover, this is the opportunity for Adenan to save at least RM400 million for the State coffer,” said Chong.

This sum of money could be used to build more schools and low cost houses for the people, he added.

He suggested that the state could have made much more if the 267.15 acres of the state land was sold through an open tender process.

Chong (right) said that for Adenan, it was the first ‘dubious’ land deal under him and urged the chief minister to put a stop to it.

“It is pure common sense that such direct alienation of state land without going through the open tender process is ‘conducive to corruption’,” he said.

On January 14, Chong submitted several documents including the agreement between the state government and the private company to the MACC.

In the letter, he described the facts in the agreement as ‘highly suspicious’ and called on the MACC to launch an investigation.

张健仁:注重砂民利益 砂火箭党员是本地人

(本报古晋24日讯)就本州首长表示在来届州选,选民要支持本土政党,包括联民党及自强党,而不应投票给来自西马政党之言论,行动党砂州委员会主席张健仁揶揄,砂国阵应该优先拒绝使用国阵的“天秤”作为自己的党旗标志,或可将天秤一分为二;因为这个标志来自西马,而整个国阵组织是以西马为主,也长期的歧视及忽略砂州发展!
他认为,如今人民最重要的考量点,就是一个政党是否可以真正捍卫及争取人民的权益,毕竟行动党也是全国政党,而该党的砂拉越党员都是砂拉越人,都是以砂人民利益为优先。
把西马资源搬到砂
他举例,该党甚至将西马的资源搬来砂州,让砂州人民受惠。
“上周,行动党在诗巫举办医药义诊,我们从西马安排10名专科医生,以及2名普通医生来替东马的郊区人民看病。这是现场义诊的形式,不只为人民提供诊断,也医治,包括小儿科、妇科、心脏、牙科、皮肤病、骨科、眼科等。”
“相比国阵,他们是将东马资源搬去西马。”
选民懂得观看政局
张健仁深信,人民看政党,不是以它是西马,或全国政党而言,乃是哪一个政党才是真正捍卫人民权益的政党!
他相信,现代的选民是聪慧及成熟的,可以观看出很多政治局面,甚至相当了解各个政党的政策及实施。

Will Sarawak party SUPP quit BN?

The question has been put to Sarawak United People’s Party (SUPP) following the state BN government’s support for the newly-formed United People’s Party (UPP), which is made up of former SUPP members.

The presence of State Minister for Housing and Minister for Tourism, Abang Johari Abang Openg, at UPP’s inaugural triennial delegates conference (TDC)  in Kuching yesterday is seen as a clear and strong indication of the state government’s support for UPP.

The presence of Abang Johari (right) was seen as even more significant becase he was announced as the official representative of Chief Minister Adenan Satem at the UPP function.

UPP was formed late year, after it broke away from SUPP following a protracted leadership crisis.

The current members of the state BN are Parti Pesaka Bumiputera Bersatu (PBB), Parti Rakyat Sarawak (PRS), Sarawak Progressive Democratic Party (SPDP) and SUPP.

Even though UPP is not a member of the state BN, two of its members are in the state cabinet - Local Government Minister Wong Soon Koh and an assistant minister, Jerip Susil.

UPP is seen as important to Adenan and the state BN because it has four assemblypersons – representing the state seats of Bawang Assan, Opar, Bengoh and Engkilili.

SUPP will strongly oppose UPP

SUPP has made it clear several times that it will strongly oppose any move to admit UPP into the state BN and that it would not give up any of its 19 seats to the UPP.

Asked about the significance of Abang Johari’s presence at the UPP meeting, Sarawak DAP chief Chong Chieng Jen told reporters that it was more appropriate for SUPP to answer that question.

“However, from our point of view, it just confirms the speculation by various analysts that UPP will be accepted as one of the component members of the state BN.

“And there is nothing SUPP can do about it,” said Chong (left), who is also the MP for Bandar Kuching and the assemblyperson for Kota Sentosa.

He said SUPP has been shouting all this while that it will not give up even one of its seats to UPP.

“What is SUPP’s stand now? What is SUPP going to do – quit BN or just keep its mouth shut and wag the tail?” asked Chong.

Asked whether the problems of UPP and SUPP would give DAP any advantage, he said the next state election would be, as usual, very difficult as the party was not only fighting its opponents, but also fighting against the Election Commission, which acts as an umpire.

“Our battle is always very difficult, very tough whether it is in the urban or in the rural constituencies. This is because the State BN is using the government machinery and the taxpayers’ money, as well as the Election Commission, to fight us.,” Chong added.

“In a soccer game, we are not only playing against our opponents, but also against the umpire, and in the case of the general election, we are also playing against the EC, which behaves as the 14th BN component party.”

He said that although DAP won 12 state seats in the last state election, and six parliamentary seats in the GE13, these always were hard-fought victories.

Lawyer George Lo is the secretary-general, with timber tycoon Tiong Thai King and Opar assemblyperson Ranum Mina as the party’s senior vice-presidents.

More than 1,000 members from across the state attended the UPP delegates meeting.

Wong said that the party has set up 24 branches with a total membership of more than 20,000 and that more branches would be set up in the near future.

选委会所建议的选区划分,根本就是为了要增加国阵的选区。

(古晋11日讯)古晋市国会议员兼哥打圣淘沙州议员揶揄,选举委员会针对所建议的选区划分的解释,其实是愈描愈黑,更加暴露选举委员会为国阵护航的角色。

张健仁今天再次抨击选举委员会为国阵的第14成员党,选委会所建议的选区划分,根本就是为了要增加国阵的选区。而过去几天选委会所给予的解析,自相矛盾。

张氏指出两点选委会自相矛盾的言论:

1. 选委会称说,选区划分为更小,是为了方便中选议员可以提供更好的服务。

若这论调可以成了的话,为什么国会选区没有增加? 难道州议员的选区需要缩小选区以提供更好的服务,国会议员就不需要提供更好的服务?
选委会自己也知道,国阵在国会没有3份2的多数议席,选委会所建议的选区划分的不公平程度,没有一位正常的在野党议员会支持。 因此,选委会的荒唐建议,怎样也是无法在国会被通过的。

2. 选委会称说,郊区或半郊区的选区面积比较大,比较难服务,因此应该有比较少的选民。

若这论调成立的话,那为什么砂督的面积如此的小,但选民人数却只有区区的1万3580人?  砂督的面积比浮罗岸州选区稍微大一点点,但比朋岭州选区或巴都林当州选区小许多。 砂督的面积也只是哥打圣淘沙州选区面积的1/3,更只是石角州选区面积的1/5而已。

但是,砂督的选民人数只是区区13580人,而其他这5个选区的选民人数却是:
浮罗岸 (22873选民);
朋岭 (30881选民);
巴都林当 (24640选民);
哥打圣淘沙 (21247选民); or
石角 (19643选民)


张氏也说,最荒谬的是,增加了11个州选区,但是国会选区连1个都没有增加。 唯一的解释就是,选委会赶紧增加州议席以应付砂州州选,因为现今多了亲国阵的联民党和力量党。 虽然这11个新的州选区不会全部给这两个“新成员”,但是至少有了一些新选区的分配,可以减少这两个“新成员”和人联党及民进党之间的摩擦。

张健仁表示,如果选举委员会还有意要挽救其所仅存的公信力和尊严,它应该收回这选区划分的建议,另外提出比较中立和合理的选区划分建议。

The integrity and impartiality of the Election Commission (EC) is called to question on the recently announced delineation exercise.  So far, the so-called further explanation or purported justification provided by the EC in respect of the delineation only reinforces the fact that the EC is the stooges of Barisan Nasional or even the 14th party in BN.

I wish to point out the self-contradictory explanation provided by the EC in respect of the delineation exercise:

1. The EC claims that the re-drawing of the area into smaller areas is for the purpose of making it easier for the elected representatives to serve their constituencies.

If that were the case, why is there no re-delineation of the Parliamentary seats?  If the ADUNs need to have their constituency sized down-sized to provide better service, why is there no such similar need for the MPs and their parliamentary constituencies?

The true reason for the non-increase in the Parliamentary constituencies is that the BN does not have 2/3rd majority in Parliament and the re-delineation is so unfair and ridiculous that the EC is confident that no right-minded opposition members of Parliament will lend their support to such proposal.


2. The EC claims that the rural or suburban constituencies are larger in surface area and thus harder to serve, and therefore need to have less number of voters.

If that were the case, why is Satok one of the smallest in surface area and yet has only 13,580 voters?

The surface area of Satok is slightly bigger than Padungan, but smaller than either Pending or Batu Lintang.  Satok’s surface area is only 1/3rd of the surface area of Kota Sentosa and 1/5th of the surface area of Batu Kawah.

Yet, Satok has only 13,580 voters whereas these other areas has the following number of voters:
Padungan (22,873 voters);
Pending (30,881 voters);
Batu Lintang (24,640 voters);
Kota Sentosa (21,247 voters); or
Batu Kawah (19,643 voters)

Anyway, it is a joke that when there is an increase of 11 state constituencies for Sarawak, there is totally no increase in Parliamentary constituencies for Sarawak.

The only plausible explanation why the EC is willing to make itself looking like a fool in rushing to increase the State seats while maintaining the number of Parliament seats is that there are now BN friendly UPP and TERAS which require certain State seats to appease.  Though not all of the increased seats will go to UPP, TERAS, or SUPP or SPDP, but it will help to lessen the conflicts.

Therefore, I call on the EC to withdraw its present proposal and redo the whole thing to come up with a new proposal.  This is the only way which the EC can hope to save whatever credibility it has left.

新选区的划分,再次证明选举委员会只是国阵的工具,它的存在是为了确保国阵赢选举

(古晋5日讯)古晋市国会议员兼哥打圣淘沙州议员张健仁称,新选区的划分,再次证明选举委员会只是国阵的工具,它的存在是为了确保国阵赢选举。
张健仁是针对今日选委会所公布的新州选区划分而做出如是抨击。
张氏说,选委会的重新划分选区,完全违反了民主投票的基本原则,即“一人一票一个价值”的原则。 就以古晋市的选区为例,原本已经是砂州第二多选民的选区,在新选区划分下,还加入一个巴都林当选区,选民人数从原来的5万2000人,增加至7万8000人。
“这种选区划分方式,死不要脸的摆明偏帮国阵,选举委员会倒不如直截了当加入国阵成为国阵的第14个成员党?”
张氏说,选委会这种不知廉耻偏帮国阵式的选区划分,是基于一个假设,即,乡区的土著会永远支持国阵的假设。
“根据过去的选举成绩,乡区的土著确实是支持国阵。但这并非一个永远不变的定律。”
他说,从过去的选举成绩显示,城市的土著票也已开始倾向反对党,西马各大城市如此,东马的情况亦然。 这是因为社会的进步,资讯的发达,网际网络的开发和通用,使到国阵的贪腐暴露无遗。 因此,当乡村的土著开始接触电脑网络时,他们也将逐渐看清国阵的贪腐,如何的剥夺他们享有基建设施、更好的医药和教育设施的基本权益。
张健仁说,除非国阵要永远的不让乡村人民接触电脑和网络,不然乡区人民总有一天也会有政治觉醒,而相信这一天已不远了。
张氏也说,民主行动党还是会继续其进军乡区的政治工作,包括“砂拉越之梦”(迎变砂州计划Impian Sarawak projects),把资讯带给乡区人民,让他们了解,国阵的贪腐,是导致乡村地区迟迟缺乏拨款开发和发展的主要原因。
“国阵还是会继续的贪污腐败滥权,乡村人民也会有醒觉的一天。 最终,选举委员会这不公平的举动,也只是枉做小人而已,国阵还是要倒台。”

SPR might as well calls itself the 14th party in BarisanNasional

It is now beyond all doubts that SuruhanjayaPilihanraya (SPR) is working for BarisanNasional (BN). The new delineation exercise that has just been announced today has dispelled all doubts that the SPR is just a tool of the BN, helping the BN to consolidate its position and power base.
With such blatant disregard of the fundamental principle of fairness in the delineation exercise, the SPR might as well apply to join as the 14th political party of the BN.
The new delineation exercise has defied the basic principle of one-person-one-vote-one-value. The most glaring anomaly is the Bandar Kuching parliamentary constituency which was already one of the most populous constituencies (52,000 voters), has an addition of BatuLintang state constituency, increasing the number of its voters by another 25,000 to more than 78,000.
However, this disgraceful attempt on the part of the SPR to help BN to win more seats is based on the assumption that the Malay and Dayak voters in the rural area will forever support the BN.
Much as the SPR would like to help the BN, such assumption of perpetual support from Malay and Dayak in the rural area will not stay unchanged forever. This is because as the society progress and with the coming of the internet age and access to information to the Malay and Dayak communities in the rural area. This trend can be seen from the increase in Malay and Dayak support in the urban areas.
Therefore, unless the BN intends to keep the rural community uninformed of the current political and economic development of the country and the state, otherwise, there will surely be a change of political minds amongst the rural people.
We the DAP will continue our efforts in the rural areas, to supply information of cronyism and corruption to the communities there and how such cronyism and corruption have deprived them of their basic amenities, eg. basic infrastructure, reasonable education and medical facilities, etc.

Does Adenan has the political will to put a stop on dubious land deals for Barisan Nasional crony? Or is Adenan only paying Lip Service to Clean Governance?

In the November, 2014 Dewan Undangan Negeri Sarawak sitting, I have submitted a question as follow:
“  6.    To ask the Chief Minister and Minister for Resource Planning and Environment:  To state the rationale for the sale of State land Lots 128, 5489, 5490, 5491, 2301, 2304 and 5279 all of Block 225 Kuching North Land District (a total of 267.15 acres) to Standard Parade Development Sdn Bhd at a mere RM115 million.”

Those parcels of land are situated opposite Batu Kawah MJC Commercial Centre.  Anyone in the know about property market in Kuching will know that the market price for land in that area is in the region of RM2 million per acre.  For such large parcel of land with a total area of 267.15 acres in that area, the market price is easily RM500 million.

“    Lot 128, 5489, 5490, 5491, 2301, 2304 and 5279 all of Block 225 Kuching North Land District telah dilulus untuk diberimilik bagi pembangunan bercampur seperti rumah kedai, showroom dan lock-up shop, bangunan industry, institusi pendidikan, bangunan pejabat dan pelbagai jenis rumah kediaman.  Selain daripada itu, tanah yang diguna dan telah dibangunkan untuk kawasan lapang, jalan raya, perparitan, tempat letak kereta, substesen elektrik dan bangunan awam akan diserahbalik kepada Kerajaan secara percuma.  Oleh yang demikian, setelah mengambilkira factor-faktor yang disebut di atas, premium sejumlah RM115 juta yang dikenakan bagi pemberimilikan tanah tersebut adalah berpatutan dan munasabah.”
(    Lot 128, 5489, 5490, 5491, 2301, 2304 and 5279 all of Block 225 Kuching North Land District have been approved for alienation for mixed development, eg. shophouses, showroom and lock-up shop, industrial building, institution of education, office building and various types of residential house.  Besides, land which will be used for and developed into open area, roads, drains, parking space, electricity substation and public building will be surrendered back to the Government for free.  As such, after taking into consideration of the above factors, the RM115 premium charged for the alienation of the above land is fair and reasonable.)

This is similar answer given by the State Government under the previous Chief Minister, Taib Mahmud, when he answered questions on State land being alienated to BN crony companies at only a small fraction of the prevailing market price.


The ultimate question now for Adenan is: Is Adenan continuing with the previous State Government policy in alienating State Land to BN cronies at only a small fraction of the prevailing market price? 


All developers, when they develop land into commercial buildings or residential houses, will have to surrender the open area, roads, drains, parking space, electricity substation and/or public building or structures to the government for free.  However, they are still required to purchase land at the prevailing market prices, NOT a fraction of the market price. 

Any developer wishing to buy land in that area will have to buy land at the prevailing market price of approximately RM2 million per acre and when it develops the land, the open area, roads, drains, parking space, electricity substation will still have to be surrendered to the government for free. 

Therefore, the answer given by the Chief Minister does not provide a justification for the sale of State land to Standard Parade Development Sdn Bhd (SPD) at only 20% of the prevailing market price of the land.


My question to Adenan Satem is:  What is so special about SPD that it can get land from the Government at only an average of RM430,000 per acre when the market price is RM2 million per acre?  For land of the size of 267 acres, the Government is foregoing RM400 million for the sole benefit of this SPD company.


The undisputed facts about this alienation exercise are as follows:

1.       The Agreement between the Government of Sarawak and SPD was signed on 8-3-2014, which was after Adenan Satem became the Chief Minister of Sarawak.  Therefore, Adenan can’t wash his hands clean on this deal by attributing it to the decision of the previous Chief Minister.

2.       The consideration price of RM115 million under the said Agreement was to be paid in kind by SPD building one SABATI (Association of Wives of Ministers and Assistant Ministers of Sarawak) building at Jalan Bako, 1 orphanage building at Mukah and 1 orphanage building at Lawas, to be valued by JKR at approximately RM115 million.

3.       The land will be alienated to SPD even before the SPD completes the construction of the 3 buildings. 
Under the Agreement, so long as SPD commences construction of the SABATI building and signs the building agreements for the 2 orphanage buildings, documents of title to the 267 acre of land will be issued to SPD within 21 days. 
In other words, SPD only need to incur few hundred thousand Ringgit to commence construction and the State land worth RM500 million market value will be alienated to it.


In previous dubious land deals, at least the recipients of the land would have completed the projects before they received the State land as payment in kind.  In this case, SPD will receive the land even before it completes or incur substantial cost in constructing the projects. 


Such arrangement is a double rip-off on the State Government and the people of Sarawak, ie. State land is alienated to SPD at 20% of market value (the State losing RM400 million potential revenue) and even that meagre 20% is not paid before the land were alienated to SPD.

By the looks of it, it seems that the land-grabbing is worse under Adenan’s administration.  Though Adenan has previously forbidden his direct family members from applying for State land, but it would be the same if he continues to allow BN cronies to get State land at only fractions of the market price.

This dubious land deal has thrown doubts onto Adenan’s statements about clean and good governance and the integrity of his whole Administration. 

How can a Chief Minister who advocates for clean and good governance allow such double rip-off to happen right under his nose?  If Adenan Satem does not stop this land deal, all his talks about clean and good governance will become hot air and mere window-dressing.


Therefore, I urge Adenan Satem to walk the talk and act immediately on this dubious land deal.  Otherwise, he will disappoint all those who harbour hopes of reforms and change in the State Government under his leadership.

I also urge the Malaysian Anti-Corruption Commission (MACC) to carry out investigation on the matter.  If MACC wishes to have any document on the land deal, I am prepared to furnish the MACC with all the document in my possession provided that it must act on it and not pay lip service only, giving in to the power that be.

砂州首长是否真的要停止廉价售卖政府地给国阵朋党公司,还是只是口惠而实不至?


(古晋3日讯) 民主行动党古晋市国会议员兼哥打圣淘沙州议员张健仁质问砂州首长阿迪南是否有真的意愿要停止廉价售卖政府地给国阵朋党公司,还是只是口惠而实不至。

张健仁透露,在去年11月的砂州议会,他提呈以下的一个问题:
 “  6. 询问首席部长兼天然资源与环境部长,政府为何只以区区的1亿1500万令吉的价格,售卖Lots 128, 5489, 5490, 5491, 2301, 2304 and 5279 all of Block 225 Kuching North Land District (总共267.15英亩)的政府地给 Standard Parade Development有限公司?

张氏说,这些地段是座落在石角路MJC商业中心对面。 任何对于古晋地产稍微有认识的人都知道,那一带地的市价,大约是1英亩200万令吉。 一片267英亩座落在那一带的土地,市价大概是5亿令吉。

张健仁今日在新闻发布会上展示首席部长针对他的问题给予的答案,关键的答案如下:
 “ Lot 128, 5489, 5490, 5491, 2301, 2304 and 5279 all of Block 225 Kuching North Land District 以被批准为综合发展,包括店屋、陈列室型的商店、lock-up店、工业店、教育机构、办公室建筑及各式房屋。 除此之外,那些用以发展为空地、道路、沟渠、停车场、发电站、公共建筑的部分地段,将归还给政府。 因此,若考虑到这些因素,1亿1500万令吉的价格出售这片政府地段是合理的。

张健仁指出,这种答案跟之前在泰益当首席部长时代,针对政府廉价卖政府地给朋党公司的问题所给予的答案,完全一模一样。

有鉴于此,我们毕竟要问,阿迪南是否还将继续前朝政府以廉价售卖政府地给国阵朋党公司的文化?


为何特别优待朋党

张氏说,任何发展商要建商店或房屋,也必须将空地、道路、沟渠、停车场、发电站、公共建筑归还给政府,但是它们还是需要以市价买地充作发展用途。 就以MJC一带的地段位列,任何一位发展商若要在那里买地建商店或房屋,他们还是需以越每英亩200万令吉的价格买地,之后,当他们发展他们的地时,他们也必须将空地、道路、沟渠、停车场、发电站的那部分土地免费归还给政府。

因此,阿迪南所给予的答案根本没有解答到为何砂州政府以市价的20%的价钱,售卖那片政府地给Standard Parade Development有限公司。 我也要质问阿迪南,这间Standard Parade Development有限公司到底有什么特别之处,政府愿意将一片5亿令吉的政府地,只是以区区的1亿1500万令吉出售给它?


有关这项交易,张健仁列出3个无可否认的事实:

1.       砂州政府与Standard Parade Development 有限公司签署的合约日期是201438日。 这是阿迪南成为砂州首席部长之后。 因此,阿迪南没有藉口说这是前朝首长做的事。 他不能以此藉口来推卸责任。

2.       在合约下,这1亿1500万令吉是以物物交换方式偿还。Standard Parade Development 有限公司将为砂州政府建3个建筑物,即:座落在Jalan Bako SABATI (砂拉越部长夫人和助理部长夫人公会)大夏、分别座落在沐胶和老越的孤儿院。

3.       Standard Parade Development有限公司不需等到完成这3个建筑物,就可先得到那267英亩的政府地。
在该合约下,只要Standard Parade Development有限公司开始建SABATI大夏及签署承建那两个孤儿院,土地局就必须在21天之内,发那267英亩地的地契给这间公司。
换言之,Standard Parade Development有限公司只需要花费区区几十万令吉,就可先得到价值5亿令吉的土地了!


张氏表示,过去政府廉价出售政府地的交易,至少那些得到政府地的公司,是先做好有关的政府工程,政府以政府地偿还工程的价格。 但是,现今MJC对面这片地段的交易,Standard Parade Development有限公司连那3个建筑物都不需要做好,就可以先得到价值5亿令吉的政府地了。


双重剥削砂州人民

张氏说,这简直就是双重剥削,即:
1.    政府地以市价的20%卖给这间公司,砂州政府和人民损失了越4亿令吉;
2.    就连这么低(20%)的价钱都还没有收到,政府地就已经过名给这间公司了。

这种以政府地自肥朋党的操作,似乎在阿迪南上任首长之后变本加厉。 虽然阿迪南曾说过不允许他的直系亲属申请政府地,但是,不允许他的直系亲属申请政府地,却允许国阵朋党以如此廉价和方便就得到政府地,对砂州人民而言,还不是和泰益时代的政府一样?


张健仁指出,如此充满疑点和不寻常的政府地交易,已让人民开始质疑阿迪南要实行廉政的意愿到底有几份真,同时,它也使到人民对州政府在阿迪南统领下的诚信,失去信心。 一个口口声声说要落实透明廉政的首长,又如何可以允许这种双重剥削的事件,在他面前发生?

张氏也指出,如果阿迪南没有停止这个MJC对面政府地的交易,那人民就可以断定,阿迪南在他上任之后所讲的廉政,只是在粉饰砂州政府的行政,塑造一个不真实、表明廉政的形象。


促阿迪南言行一致

张氏呼吁阿迪南,应该要说到做到,不要口惠而实不至。 否则他将让许多对他即已厚望,希望他能为砂州带来好的改变的民众失望。


同时,张健仁也敦促反贪委员会立刻进行调查。 他也表示,若反贪委员会由意要向他索取有关土地交易的文件,他很乐意提供给反贪委员会,但反贪委员会必须真的去调查而不是空口说白话,到最后又是受到政治压力而放弃调查。
